Miscellaneous Duties-Service Responsibility Of Distributor
MISCELLANEOUS DUTIES-SERVICE RESPONSIBILITY OF DISTRIBUTOR
It is the responsibility of distributor to provide users of the goods of manufacturer in the territory of distributor with efficient repair and replacement parts service. For those purposes a stock of replacement parts and an efficient service organization, adequate in relation to the needs of the territory of distributor, shall be maintained. These functions may be performed by distributor or by other parties designated by distributor. If through arrangements made by distributor any of these functions are performed by organizations other than that of distributor, the organizations performing these functions and the arrangements made with the organizations shall be subject to prior approval by manufacturer. No matter by whom the functions are performed and regardless of any approvals given by manufacturer, manufacturer shall hold distributor responsible for the adequacy of the repair and replacement part service made available to users of the goods in the territory of distributor. Manufacturer shall make available to distributor the information necessary for adequately servicing the goods, and distributor shall be responsible for the adequate training of persons servicing the goods.
